We need an investor/lender. We have an opportunity to exploit a mortgage niche that no one (but no one) is considering. The amount required to fund the project is $500,000.
It turns out that fully 85% of the mortgages from 2004 through 2009 have serious Real Estate Settlement Procedures Act (RESPA) violations. RESPA violations carry VERY stiff penalties, ranging from$2,000 per incident to treble damages and rescission of security interest. This means that of the hundreds of thousands of foreclosures executed since 2004, the overwhelming majority were improper due to these RESPA violations!!!
These days, everyone is into loan modification – negotiating lower payments, lower interest rates for overwhelmed borrowers. We want to negotiate settlements for improper foreclosures!! We will have a huge jump start because it is not being done.
Here is how it works: we conduct a forensic audit of the foreclosed loan. This audit, prepared by a specializing audit preparer, will generate 19 to 30 page report identifying every violation, minor and serious. This report is irrefutable as there are no allegations, only facts. Presented with this report, the lender has two options – settling the case based on what we are asking or litigation.
Settling with us, though expensive, will be an easy call for the lenders. The alternative could be treble damages and the dreaded rescission of security interest (loss of the property).
The smallest case we will consider will generate a $100,000 settlement. Our agreement with the client will call for a 30% donation to our organization, or $33,333. At our startup staffing level, we can administer 25 – 50 cases per month.
